
Data Center Siting Friction Becomes the New Development Bottleneck
Texas, Fort Worth, and Pennsylvania tightened the rules within days of each other, while a federal permitting order pushes the opposite direction.

One hundred. That is roughly how many local moratoria on data center development communities across the country have adopted in the past two years, according to tracking by Columbia Law School's Sabin Center for Climate Change Law. In the last two weeks alone, Texas, Fort Worth, and Pennsylvania have each added a new layer of friction, and the pattern is now specific enough to change how developers underwrite site timing.
Local Governments Move First
Texas Gov. Greg Abbott ordered a comprehensive audit of every data center connecting to the state's electricity grid in August 2026, directing the Public Utility Commission of Texas and the Electric Reliability Council of Texas (ERCOT) to review the pipeline before new projects proceed, an action that functions as a statewide pause even though it stops short of a formal moratorium.
The state-level action follows months of local resistance across Texas. Austin County adopted its own pause on new AI data center development, El Paso imposed a 300-foot buffer requirement between data centers and residential areas, and Fort Worth's City Council voted unanimously on August 11 to begin the process for a 90-day moratorium on new data center construction, giving city staff time to study the facilities' effect on natural resources and quality of life before any regulatory framework is written. A separate lawsuit against Hill County over its own moratorium led that county to rescind its policy, a reminder that local rules face real legal exposure even as the political pressure to adopt them keeps building.
Pennsylvania's approach shows a different model. Gov. Josh Shapiro signed Executive Order 2026-05 on August 18, establishing binding GRID Requirements that condition favorable permitting treatment and state tax benefits on a developer's compliance with energy, infrastructure, environmental, workforce, and community standards. Rather than pausing development outright, Pennsylvania is using the state's own incentive and permitting levers to extract commitments before granting fast-track treatment, and central permitting provisions now apply to any data center above a specified demand threshold.
The Federal Framework Pulls the Other Direction
These state and local actions sit in tension with a federal posture that has pushed the opposite way. Executive Order 14318, Accelerating Federal Permitting of Data Center Infrastructure, directs federal agencies to streamline environmental review and use federal land for qualifying projects, defined as those committing at least $500 million in capital or adding more than 100 megawatts of new load, and became effective July 1, 2026.
That federal acceleration push came paired with a cost commitment. On March 4, 2026, President Trump convened seven leading AI companies and hyperscalers at the White House to sign the Ratepayer Protection Pledge, a voluntary commitment that data center expansion should not raise electricity costs for American households. The pledge addressed the same anxiety now driving state and local action, but it carries no enforcement mechanism, and states have moved to write their own binding versions of the same idea. New Jersey's Data Center Fair Share Act, signed July 7, 2026, requires facilities of 50 megawatts or larger to commit to paying at least 85% of their projected power costs for a decade. Virginia added a first-of-its-kind data center energy consumption tax of $0.011 per kilowatt-hour, capped at $600 million annually, as part of a budget agreement reached June 30.
The federal order streamlines permitting on federal land and through federal agencies. It does not preempt state siting law, local zoning, or state energy regulation, which means a project cleared for expedited federal review can still stall at a county commission meeting or a city council vote. That gap between federal acceleration and local authority is where execution risk now concentrates.
Two Layers of Approval, Two Different Clocks
For a developer, the practical effect is a two-track approval process running on two different clocks. A project's federal permitting timeline, potentially accelerated under Executive Order 14318, tells a developer almost nothing about how quickly local zoning, environmental review, and utility service questions will clear, and Fort Worth's packed council chambers show that public opposition can move faster than any regulatory calendar once residents organize around water use, noise, and infrastructure strain.
That is a planning problem, not just a political one. A site that clears federal review but sits in a jurisdiction actively drafting new data center rules carries a schedule risk that belongs in the underwriting model alongside interconnection timing and utility service confirmation. Developers should treat local governance status the same way they now treat grid capacity: as a variable to document and monitor before capital commits, not a formality to confirm after.
What Belongs in the Site Selection Model Now
Three questions deserve a place in every data center and large-load site evaluation going forward. First, has the host jurisdiction adopted, proposed, or discussed a moratorium, buffer requirement, or specific zoning overlay for data centers, and what is the timeline for any pending action. Second, does the state have a binding cost-allocation or ratepayer-protection law on the books, such as New Jersey's or Virginia's, that will shape the project's power cost structure regardless of what a voluntary federal pledge assumes. Third, does the project's capital and load threshold place it inside or outside the federal acceleration framework, and does that federal treatment actually reach the state and local approvals the project still needs.
The through-line across Texas, Fort Worth, Pennsylvania, and the federal actions that preceded them is that power access and community consent have become inseparable siting variables. A parcel with abundant capacity and a willing utility can still stall behind a council vote, and a project with federal fast-track status can still meet a local moratorium it never saw coming. The sites that move forward fastest now will be the ones where a developer has mapped both clocks before breaking ground.
